Notice Privacy

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter "the Law"), we would like to inform you of the following:

Promotora Procsa, S.A.P.I. de C.V., (hereinafter "Procsa"), with address at 235 Progreso street, Colonia Escandón, Miguel Hidalgo, Postal Code 11800, Mexico City, will be responsible for the Personal Data that is provided by natural persons to who correspond the same (hereinafter "the Holder"), for itself or for any of its controllers, affiliates or subsidiaries.

For the purposes indicated in this Privacy Notice, Procsa may collect the Owner's Personal Data such as name, sex, address, landline, cellphone or office phone number, email, nationality, date of birth, marital status and marriage regime, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), Social Security Number (IMSS or ISSSTE), electoral page, studies, occupation or professional activity (company or workplace), number of bank accounts, number of bank cards, patrimonial information, as well as their image through the surveillance cameras that Procsa has in its establishments, in one of the following ways: I) when the Holder provides them directly, II) when the Holder goes to any of the establishments of Procsa (Grupo Procsa), III) when the Holder uses the Procsa website or online services (Grupo Procsa) and IV) when they are obtained by Procsa through the sources permitted by law .

Processing of personal data
The treatment of the Owner's Personal Data that is made available to Procsa in any way or circumstance, may be resolved in accordance with the terms and conditions of this Privacy Notice, so that, from this moment, it is understood that the Owner consent to such processing.

The Personal Data information, which is collected by Procsa from the Owner with their full consent, will have the use described below: i) for the provision of services, goods or products offered by Procsa (hereinafter the Services), ii) ) identification of the Holder, iii) administration of the Services, iv) analysis of the Services, v) updating of data, vi) sending the information of the Holder to Credit Institutions with which the first can obtain a loan to acquire a housing (in no case will Procsa be responsible for the Credit Institutions to which the Holder's information is sent, whether or not they grant the latter credit to acquire a home) as well as the Public Notaries with whom, if applicable, the home purchase and sale operations by the Owner and any other purpose compatible or analogous to these, purposes that are necessary to fulfill the obligations derived from the legal relationship that Procsa has with the Owner. Likewise, within the use that Procsa will give to the Holder's information is the offer and promotion of goods, products and services and/or commercial prospecting, as well as for the security of Procsa's establishments for purposes that are not necessarily required to comply with the Obligations derived from the legal relationship that Procsa has with the Holder.

It is the responsibility of the Owner of the Personal Data to guarantee that the data provided directly to Procsa are true and complete, as well as to notify Procsa of any changes to them in order to comply with the obligation to keep the information updated.

The temporality of the handling of the Owner's Personal Data will depend on the legal relationship that is held with Procsa, as well as the obligations required by current legislation, the competent authorities and the internal policies of PROCSA.

Only those persons authorized by Procsa will have access to the Personal Data, whether they are workers, service providers, business partners or third parties who have a legal relationship with the former, who, derived from said legal relationship, need to know the information and who assume the commitment to maintain the information under a strict order of confidentiality and security and acknowledge knowing the terms and conditions of this Privacy Notice, committing to comply with them.

Likewise, Procsa will transmit the Personal Data of the Holder to i) the Credit Institutions with which the Holder can obtain a loan to acquire a home (in no case will Procsa be responsible that the Credit Institutions, to which The Holder’s information is sent,grants or not to the latter credit to acquire a home) and/or ii) to the Notary Publics before whom, if applicable, the purchase and sale operations of the homes are formalized by the Holder and Procsa will notify said Institutions de Crédito as well as Public Notaries this Privacy Notice.

In the event that the protected Personal Data is required by an authority of any kind, either by legal process, to respond to any claim or legal action, or to protect the rights of Procsa or its clients and third parties; These data will be made available to you in strict compliance with the Law.

The Holders of the information will have the right to request access, rectification, revocation, cancellation or opposition, as well as to limit the use or disclosure of their data, through:

1. A written request addressed generically to the Personal Data Committee of Promotora Procsa S.A.P.I. de C.V., to the following address: 235 Progreso street, Colonia Escandón, Miguel Hidalgo, Postal Code 11800, Mexico City, from 10:00 a.m. to 5:00 p.m., on working days.
2. A request made to the email privera@procsa.com.mx.

Procsa will respond to the requests of the Holder of the information, as long as any of the exceptions contained in the Law are not updated, and the applicant complies with the provisions of article 29 of said legal system that establishes the requirements that must be contained in the applications submitted by the Holders.

In order for Procsa to process the request of a Holder regarding access, rectification, revocation, cancellation, opposition, limitation of the use or disclosure of their data, the latter must attach the following information and documentation to their request:

1. Name of the Holder and address or other means for Procsa to communicate the response to your request.
2. The documents with which he proves his identity or his personality in the case of the legal representation of the Holder.
3. . The clear and precise description of the personal data with respect to which the right of access, rectification, revocation, cancellation, opposition, limitation of use or disclosure is sought, as well as any other data or document that may facilitate the location of Personal information.

The obligation of access to information will be deemed fulfilled by Procsa when, if requested by the Holder, their Personal Data is made available to the latter at Procsa's address or through any of the established forms. in article 33 of the Law.

In the event that Procsa requires the use of your Personal Data for purposes other than those agreed under the legal relationship that it has with the Owner and in this Privacy Notice, the Owner will be notified in writing, by telephone, or electronically. , or by any optical, sound, visual or other means that technology allows now or in the future, explaining the new uses intended to give to said information in order to obtain your authorization. With this Privacy Notice, the Holders of the information are duly informed of the data that was collected from them and for what purposes it may be used, as well as the fact that the Privacy Notice may be consulted at any time on the Procsa website. www.gprocsa.com.mx , accepting the terms contained in this Privacy Notice, which is prepared in compliance with the Federal Law on Protection of Personal Data Held by Private Parties.

Procsa reserves the right to modify this Privacy Notice to adapt it to new legislation or jurisprudence as well as to commercial practices. In such cases, the reference changes will be announced on the website.

This Privacy Notice, as well as the general handling of the Law by Procsa, is governed by the legislation in force and applicable in Mexico. Any controversy that arises due to its application must be ventilated before the Federal Institute of Access to Information and Data Protection (IFAI) and/or, when appropriate, before the competent Judicial Bodies in Mexico City.
